QUESTION

What can I expect from legal advice.

Asked on Nov 26th, 2019 on Medical Malpractice - Florida
More details to this question:
I had a 1mm nodule on my lung. Within my 15 minute visit with a surgeon I was told he would remove the nodule and some surrounding tissue. I told the surgeon I had an option to do radiation or surgery. He told me the surgery would be minor and the nodule would be gone. I expressed I did not want any extensive surgery but if what he told me was true. I would agree. After surgery I woke up without 2//3 of my lung, a broken rib and minus 9 lymph nodes. I already have no lymph nodes in my right arm due to breast cancer so I expressed that concern prior to surgery. According to the surgeon, the nodule was 2.5mm and his report shows that the radiologist damaged my lung when performing the biopsy. I specifically expressed I didn't want extensive surgery and I wonder if he removed that much of my lung because of the damage incurred by the radiologist. I am extremely angry that my wishes were not heard. I can never get my lung or my lymph nodes back.

You can expect a lawyer to inform you that whether the hospital and surgeon were negligent and whether you have a claim that can proceed will depend upon obtaining an opinion from a medical expert, and in this case, may depend upon what the written consent form says and if it was signed for the surgery.  Any attorney would tell you that we would need to obtain all the medical records and chart and then a discussion and consultation over the incident and the potential for a claim would be discussed.  If you signed an informed consent for the procedure, that may preclude any such claim, but that's only a part of the inquiry here, and may not be dispositive of the issue of whether someone's treatment of you was negligent.  Consult a lawyer.
