QUESTION

What should I do?

Asked on Dec 13th, 2013 on Medical Malpractice - South Carolina
More details to this question:
I clean a medical facility and a dirty needle was thrown away in regular trash instead of sharps disposal. While pulling trash bag from can I was stuck in the chest with the dirty needle with remnants of blood that had set in trash can of CT where the contrast liquid is disposed of. Required tests were immediately taken, incident report filed, HIV negative still waiting on other test results. Do I have any legal recourse against the facility? I am very scared and do not know who to ask for help.

What happened to you is horrible and frightening.  However, in order to have legal recourse, you need to have suffered damages.  So far the tests have come back negative, thank goodness.  If any of the tests show you have contracted ANYTHING from being stuck, you will have suffered damages and can take action.  Right now you have had pain and suffering, but usually you need actual damages (like contracting a disease) in order to sue for pain and suffering.  It is good that you immediately notified them as to what happened to you.  I assume they are stepping up and taking care of you.  If you do have any actual damages, even an infection because of being stuck, you might have legal recourse.  I hope this helps.
