When is medical malpractice appropriate?

More details to this question:
I have been left in a re-hab facility for over a month. My orginal Surgeon went on vacation and left another surgeon in charge of his work which blossomed into a by-pass and amputation of two toes on my right foot. I saw the orginal doctor once after vacation and never since after that. I can't work, can't go home and am stuck having the re-hab doctors working on me. I want The orginal doctor to pony up and pay.

It is difficult to say whether you have a viable malpractice case without more facts, but if you want to investigate a case,  you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free.
