will my husband and I havea case?

my husband got hurt back in March of this year so I took him to the er. The doctor there said he just had a pulled muscle in his back with no imaging done. He told him to be off work for two wks and refered him back to his old back doctor. During this time he lost his job. The back doctor didnt see him but one of the associates did and had a mri done. They said a disc was out but it would be okay and refered him to a pain clinic which has been giving him nerve meds and shots. This past month he found out from his pcp while there for redness all over his body that the associate at his back doc sent him an email saying he needed back surgery that his disc was broken and sitting on the nerve. Now the nerve damage could be permanent and he has to go for another mri because more inlikely his has to have surgery. He is in so much pain everyday and cannot function like he used to. It kills him to go to work everyday. Please tell me someone can help us. WE have five kids to take care of.
