wondering if i have a case against my daughter's docotr.

More details to this question:
my husband brought my 5 year old to the doctor tuesday because she has been running a fever and vomiting, the doctor told him without any checking her out that it was just viral and that she doesn't believe in giving little kids medicine and to just go home and make sure she gets liquids and doesn't dehydrate. He was told it would take 3 days to run it's course. it has been a few days and the fever has only gone up. she has not gotten better so he took her back today on thursday. The sent her to the er for testing and blood work and then back to the dr's office to inform him that he waited too long to be seen and she has the flu but it's too late to do anything for her because it has surpassed the 72 hours so now she has to let it run it's course still and give her tylenol. it's what we were told tuesday and now my 5 year old has to continue to suffer because her dr refused to test her the first time.

If you are willing to spend the several thousand dollars for an expert opinon on the issue then you can ask that question. Other than that, there is nothing in your facts that remotely support a malpractice claim.
