I had a laminectomy L5-S1 to decompress a nerve on March 8th of this year at a local hospital in Port Charlotte, Fl. I laid in pre-op for 6 hours waiting to go to surgery. After two additional admissions in April for severe back pain and inability to walk a MRI was ordered and fluid collection was found under the incision. Aspiration was done and a Staph infection was found. I had to have an incision and drainage and flush out of the surgical site. I was sent to a rehabilitation facility for 3 weeks, was on IV antibiotics for 10 weeks and the infection persisted. The infectious Dr and surgeon then decided I should have some old hardware removed from a previous lumbar fusion done in 2004 as they felt the infection may have migrated to the hardware. On July 31 I had this hardware removed cultures done and a different bacteria grew on the hardware which I am now being treated for. I have lost the last 6 months of my life and now have to use a walker to get around.. Would I have a case?
Hello Dudley,
I am sorry to hear about what you have gone through post-surgery.
Request and review of your medical records will need to be made to determine if the standard of care was breached by the hospital, physician(s)and possibly others for not properly treating you and, if that breach caused your injuries including whether the the hardware removal from the 2004 surgery is related. Questions will also need to be answered regarding what further care is needed and what damage has been done?
