The general answer is no. An insurance company can opt to have the car repaired unless the value of repair is 75% of the value of the vehicle. In certain circumstances, however, you may be entitled to the diminished value of the vehicle. The diminished value is the reasonable value of necessary repairs to any property which was damaged plus the difference between the fair cash market value of theproperty immediately before the occurrence and its fair cash market valueafter it is repaired.
