After 4 years can I file a workers comp case? How?

More details to this question:
I had a back injury about 4 years ago and the employer never sent me to the doctor over the years my problem is worst, I have been to several doctors, but know I have disk damage and sciatica on both of my legs. I have been referred to the Neurosurgeon for back surgery. Is there anything I can do?

Every state has different rules. You need to hire a good workers comp lawyer immediately. If you are in Nevada, I know an excellent one.

You have 2 years from the injury or last payment of compensation to file a claim for compensation. There is no time limit on making a medical claim.

In Michigan, you only have 2 years. Talk to a local lawyer because maybe your state has a different Statute of Limitations.

Workers Comp. has become a highly specialised area of law. Locate a lawyer who practices this area of law, and ask him or her. To find such a lawyer, you can try the net (e.g. Avvo.com and other such sites), the yellow pages, or the lawyer referral service of your state bar. Sorry I could not helpbut the answer will not be hard to find.

Why have you waited so long? ?Normally, you must file a claim for an on the job injury within one year of the injury or the date of the last providing of benefits. There are some exceptions, but you do not provide enough information for me to know if you qualify. ?If your employer knew you had an injury, he was supposed to file paperwork. ?You need to immediately go to some local Workers' Compensation applicant's attorneys to see if they can do anything for you. ?There will be no charge unless you hire them.

The four year old injury is probably dead. In Montana, an injured worker has 30 days to report an injury to a supervisor and one year to file a written claim for compensation. If your job slowly caused degeneration and aggravation as you continued working, but now it is too serious to ignore, you may qualify for occupational disease coverage. Harms that a job causes over more than a single day fall into this category. Call the Department of Labor in Helena and file an OD claim. Don't use the old injury date because you apparently continued working so that injury must have been stable. The new OD is why you need medical treatment now.

Are you sure you didn't file a worker's comp case? You said you have been to several doctors (the employer doesn't send you to a dr) How are your medical bills being paid? Did you lose time from work? If so, did comp pay you anything? In NY you have 2 years to file a claim. If you have not done so within 4 years, I can't figure out why.
