I live in an Co-op Apartment building in NYC. The building does not have an actual garage with parking spots but it has an alley which the superintendent uses for garbage disposal, additionally 3 cars also park in that alley with mine being one of them. When i began paying to rent one of those parking spots there was only 1 car parking there. Since then the building has decided to Rent out an additional 3rd parking space in that alley as of December 2019. The vehicle that is occupying the 3rd parking space is a very large vehicle that i need to pass in order to get in and out of my spot. This 3rd vehicle is so large that it does not let me enter or exit my parking space safely. I reached out to the building management and informed them that this is dangerous and for them to do something about it. They ignored my request. If while i am parking i hit the 3rd vehicle is the liability on me or on the building for creating an unsafe environment. Can anything be done ?
You have a legal duty to operate your motor vehicle with reasonable care under existing circumstances. Although the building is arguably allowing too many people to park in this alley, this does not relieve you from liability if you accidentally hit another car. if you continue to park there you do so at your own risk. The safest bed would be to park somewhere else.
