Are they in the wrong?

I went to the Schottenstein Center on Monday night to see the Story Tour! Beautiful venue you have and the people were wonderful! At intermission I was talking with one of the workers when I thought the chair I sat on broke, my hips and knee's went one way and my head and neck another way! Needless to say everyone around me and the worker were all asking "you ok you ok" because I was so embarrassed I got up real fast and saw that I didn't break the chair it had fallen in a hole, when they put the floor together there were spots that had holes. I live in Indianapolis and we had to get home. I have been on my back ever since this has never happened to me before, who do I talk to about what I need to do? I am in a lot of pain! The girl that worked there old me to let them know if there was anything they could do! She and all the people around that area can verify it! This was negligent in the people who put those chairs there! Please let me know what I should do!

Dear Anonymous,   I am sorry to hear of your fall.  A public venue has a duty to keep the premises reasonably safe for its invitees.  Depending on the severity of the condition, whether the defect was open and obvious, the landlord may be responsible for your injuries.  However, irrespective of who may be at fault, most commercial general liability insurance policies have a medical payments provision.  I would make sure you report your fall and your injuries to the venue, and make sure they put their insurance company on notice of your fall and subsequent injuries.  This coverage can be used to pay for any medical expenses that you incur.  Usually the limits of medical payments coverage are fairly small, although not always.  Hopefully, you will recover from your injuries very quickly, but in the event you do not, you may need the help of an experienced personal injury attorney to assist you in dealing with insurance companies, medical providers, etc.  If I can be of any assistance, please do not hesitate to contact me for a free consultation.   Best, Christopher E.
