So in the state of Florida anytime a person has a car accident the first $10,000 of his own PIP insurance pays for his medical treatment. If you were at fault or not, it does not matter. You still have to use your PIP coverage. However, if you suffered any injury soft tissue or otherwise, and the accident was the fault of the other driver, then you could pursue a claim for lost wages, medical bills, and pain and suffering against the at fault driver.
