auto accident

More details to this question:
I was in an auto accident last week on the freeway and was hit from behind which caused my brand new vehicle to be totaled. My neck and back are injured. I now have no down payment to purchase a new car so I am now without a car because of someone else's reckless driving, who happened to be a cop driving his own car. Can i sue the driver or his insurance company?

The simple answer to your question is yes, given the facts you provide you have a strong claim against the driver of the vehicle which ran into you.  His insurance company will provide him with a defense lawyer, but the party you would actually sue is the driver.  Since it is certain that he will have a lawyer, you would be best served by hiring a personal injury lawyer to represent you.
