Auto accident BI settlement release

More details to this question:
Other party was found at fault, adjustor sent over policy, and has offered to pay them. In the phone call and letter it stated that once I sign the release and have it notarized they would send the check. Well nit 48 hours later the insurance company deposited the amount into my checking account without never having me the sign the release. 1st question what if I never sign it (even if they send it)? What if I do sign it and then send a check? My assumption is the deposit was somehow made on error, only because she said she needs the release before she could issue the check

There are potentially other issues of concern if your case case has value in excess of those policy limits where there may be other potential defendants and carriers available. There is no way to know this based upon your query. It would be wise to seek a full review of this matter to make sure all issues have been covered properly, ec, etc.  There are time limits, requirenents and Statutes of Limitaion and Repose which may apply and could barr any additional recovery as wellas and in addition to your Release.
