Automobile accident

More details to this question:
I was involved in an accident. The at fault driver has no car insurance and my car was a total loss. My insurance company, the GAP insurance, and the warranty company have all paid out towards the balance owed on my vehicle. I still have a remaining balance of $1133 that I have to pay to the finance company. Can I sue the at fault driver in small claims for the balance I have to pay on a vehicle I can’t drive and don’t have anymore?

Yes - but its not lilkely worth the effort. There is no ATM at the courthouse when you win. You still have to legally collect the money.
