backing a car up

More details to this question:
I was backing up my car from a parking space and checked behind me and saw no car ,when another car a second later a car appeared in my rear view mirror ,so I hit my brakes to stop but hit the rear left quarter panel of the car and did minor damge to my car and his car and he is claiming it was my fault.There was no police report

Since you do not mention being injured in the accident, I suggest that you take this matter up with you auto insurance company so that it can do an investigation and try to determine if you, the other driver or both of you were at fault for the collision. Also, keep in mind that the vehicle traveling down the aisle of the parking area likely had the right of way since you were backing out of a parking spot and you had the duty to make sure it was safe to do so.
