QUESTION

Being sued for an auto accident from January 2015

More details to this question:
I recieved a summons yesterday for my husband pertaining to an accident I had on January 15, 2015. I called the attorney listed on the summons to figure out the details. He stated my information was sent over by progressive on a spreadsheet they recieve for non insured at fault auto accidents. I was confused by this because I had insurance always have and was told the last time I spoke with my adjuster about this claim that it was settled and he was closing it out, my damages were handled as well as the other party and that I was the only injured party. The attorney for the other party then stated oh yes I do see you had insurance as her vehicle was repaired but you only had PIP state minimum which is not true and I explained to him my vehicles are financed so I am always required to carry full coverage and I had full coverage at the time and he said he has to beg to differ. He then explained that his client was injured which I was never made aware of this fact. Cannot fit all.

Update Your Profile
You need to contact your insurance company immediately.  They should contact the attorney for the person suing you and should provide an attorney to handle the matter.  If you do not contact them and the time passes to file an Answer or response to the Complaint (20 days from date of service!), your insurance company can deny the claim and refuse to represent you and can refuse to pay any claim being made.  Best of luck.
