They had both been drinking. She not totally drunk. B/F very sick/drunk. Called a cab as it is the responsible thing to do. The cab warned them that they would owe $200 if they get sick in the cab. They agreed. When the b/f does begin to get sick, the cab pulls over on the highway. Girl (on the driver/traffic side) tries to get out and go over to shoulder side to render aid. Driver (a big guy) assaults her. Yanking her purse and causing abrasions on her back. Demands that she stay in the cab. Both sides call cops. Cop tells girl that the driver has the right to kill them if he thinks they are trying to steal from him. She has photos of marks on back. Driver has no marks at time of indecent. Does she have a case against the cab company/driver? or should she press charges?
You mauy have a good case against the cab company and the driver nd you should try to press the criminal charges against the driver. Though the facts are unusual, it seems a clear case of liability on the part of the driver and thus against the company.
