This was the best Category for my question. Very sorry if it's in the wrong section. I was driving westbound approaching a red light. I passed and officer who was coming out of an apartment complex facing south. I came to a complete stop at the red light with a truck in front of me. I was driving a standard car and had my left foot on the clutch and right foot on the gas waiting for the light to turn green as the red light was about to change. Once the light turned green, I gave it gas and started to move forward. Before my car could even get to the intersection, the officer put his lights on to indicate he wanted me to pull over. He came to my side of the window and I ask what I had done to merit me being pulled over. (I had clients waiting for me at my office.) He asked me if my car was in neutral at the red light. I looked down at my stick shift and said, "I had my left foot on the clutch and right foot on the gas to prepare for the up coming green light." He said that the reason he pulled me over was because I did not have my brake lights on the entire time I was at the red light. That other motorist may not see that I'm stopped and could rear end me. I asked him, "That's a law? I never heard of that law." he stated "Yes. it is a law." He then asked for my driver's license and insurance. I gave him my license and told him I would call my father to bring me the insurance. My mother took it out of the car a day ago to make copies. We just got the car and had put it on our insurance 2 weeks before this incident happened. My mother and father arrived with in 5 min. My father got out of his truck and my mother left back home because she couldn't find the copy that had the new car on it. The officer gave me a ticket for an expired driver's license (I'm dyslexic and had no clue my license had expired. Banks had been cashing my checks with it and because of my dyslexia, it never registered in my head that it was expired.)
I used to be a prosecutor and the police call this a chicken sh-ticket. I doubt if it could stick. You should get your license and registration and insurance all in order and then talk to the best traffic court lawyer you can find.I suspect there is something more going on here. you are required to have working brake lights but I have never heard of the matter you say.
I do not believe that there is a law requiring you to have your brakes on the entire time you are stopped at a light. It does not take much for an officer to stop you, but his might not be enough.
I've never heard of anything like that. Back when I had a manual transmission, I would frequently take my foot off the brake and rest it on the floorboard since we don't have hills in Florida and there was no danger of rolling.
You have a number of problems and issues, as well as possible excuses, none of which are exculpatory, except for the fact that it does sound like a very questionable stop. You are going to need a good and aggressive attorney to beat the expired license charge.
