More details to this question:
someone hit a tree on my street trying to blame me for it I am not on police report. I was traveling down the street when the other vehicle hit the tree. my insurance company is still investigating it but they will not let me change insurance companies and they keep raising my rate. can I change insurance companies?

of cousre you can change insurance companies. Your existing company is responsible for representing you and indemnifying you for claims against you for the damange done to the tree.
