QUESTION

Can I file a lawsuit for nerve damage?

More details to this question:
I entered University Hospital on February 19, 2013 for cancer surgery on my tongue and lymph nodes. I had a second surgery the next day because the incision was swollen and blood was coming through the stitches (the first mistake). The surgeon damaged a root nerve during one of the surgeries and it cannot be repaired. I am in severe pain and my shoulder, scapula and collarbone are out of place, pushing against my spine. The MRI X-rays and nerve conduction study show the damage. Three doctors at the hospital confirm that the damage happened during surgery. The Orthopedist said the surgeon had my head in the wrong position when he performed the surgery. The head Oncologist said the damage was done during the surgery and the Radiation Oncologist said my nerve was cut or damaged during surgery. Also, the MRI showed that I have two lesions in the area of my first cancer surgery; one on my vocal chords and one in my sinus area. My recent appointment with the surgeon was very strange. He knew about both the shoulder and the lesions yet he offered no help at all. I am so frustrated that I cannot get any help. I'm not a doctor but a cat scan would show whether the lesions are malignant and the damage to the nerve yet he did nothing. I am living with unbearable pain and my health is deteriorating daily. They give me all the drugs I want which I think is dangerous to my organs and the addiction problem. Other than the drugs, they have all distanced themselves from me and I need help before it goes too far. I am on SSI, Medicare, food stamps and my wife and I are living with my parents out of necessity. I have a primary care physician who is not in the system. She is appalled at the situation and very determined to find out what's going on. So far, no one will return her phone calls. I know that when I walked in the door of that hospital, my right arm and shoulder were perfectly normal. When I woke up from the surgery, the nightmare began.
