Can I get a settlement for being rear ended by a triaxle while I was working?

More details to this question:
I am a UPS tractor trailer driver and was rear ended by a tri-axle tractor trailer while on duty. I was at a complete stop at a red light The driver was charged with the accident. I am on light duty and receiving comp but it is a lot less than what I would make. I also have been in therapy and just had an MRI and I am waiting for the results. The accident occurred June 4th. In a case such as this would you have any idea if I could get a settlement and if so how much? (I understand that the later of the two questions I am sure would require more information) Thanks for your time.

It sounds like you have both a workers' compensation case and a personal injury case resulting from this accident, which can each have profound effects on one another. You can potentially obtain a settlement from one or both of those claims. You need to be sure to retain an attorney to do so, though, as the interplay between workers' compensation and tort claims is complex.
