Can I hold someone legally responsible for causing an auto accident?

More details to this question:
I was recently involved in an auto accident, the circumstances surrounding it are unusual. I was being pursued rather aggressively by my ex's new girlfriend. She chased me through city streets and caused me to run a stop sign and be t-boned by another driver. She left the scene and didn't call for help. My van is totaled and I am now a single mom without a vehicle. Can I hold her responsible for the cost of a new one?

Yes, you should make a claim against her and her insurance company. When you are approached or sued by the person who t-boned you, bring her into the matter.

Why the hell didn't you just drive to a nearby police station and report that this psycho-loon was pursuing you? The accident was your fault because you reacted instead of thinking things clearly. Someone could have gotten killed. It was your fault.

It sounds like she was at fault in causing the accident. Hopefully, you told all this to the police so that it is in their report. Rather than going through all the time, effort and money involved with suing her, though, I would file a collision claim with your insurance company and let them worry about getting their money back out of her.

You can certainly try. You can file a claim against her insurance and if they deny the claim, you can sure her. If the insurance adjuster of the court determines that it was her fault, her insurance should pay.

You are responsible for your own driving. If I had a client injured by your puerile behavior I would sue both of you and expect to get a judgment against you both. You don't play your love games on the public streets where my family drives please.

I would need more details, but generally I do not believe that you have defined a cause of action against the new girlfriend. If you believe that she is being overly aggressive your correct action would have been to make a complaint, or if you are driving, drive the police station. I certainly hope that you were insured and, if so, you should be contacting your insurance company immediately to make a claim.
