Can I not be given the report on an accident?

More details to this question:
I was in a really bad car accident. I almost died and my friend only had a concussion. She told the cop that I was driving and smoking thatโ€™s why it happened but I was not. I was smoking a cigarette. She was smoking and they were trying to give me a DUI because it was in my system but the accident happen because there was a piece of furniture in the road. My license was missing and I did not get a DUI report.

Smoking what? If you were silly enough to be "blowing weed" in a public place, then it will be hard for you to fight about anything. Talk to a lawyer.

Your recitation of facts are confusing to me, but the answer to your question is that you should contact the accident reporting division of the law enforcement agency and as for a copy, which you are entitled to.

Traffic accident reports can take weeks or longer to be completed. I have been waiting almost 6 months for an Indio motorcycle accident death report. If you have been arrested for a DUI you or your lawyer would be entitled to obtain the report upon completion. If you were not arrested then you should contact the police agency that investigated the accident and find out when the report will be ready. You can pick it up by paying a fee if requested. You can also send for the report and include a check if required. When you say, "smoking", do you mean MJ? Were you arrested?

In Alabama, you can order the report online or get it from the police station.

If I were you I would engage an attorney to look into the matter, both to procure a copy of the accident report and also to assure that you are not improperly charged. If there was THC present in your system it is possible that you may be charged with driving under the influence even though you are not actually smoking at the time of the accident.. As for your passenger, even though she was not injured as seriously as you were, it is quite possible she will be seeking to collect all or part of her damages from you or your insurance company..
