Can I sue a drunk driver who hit my parked car?

More details to this question:
My car was hit by a drunk driver while I was asleep. It was parked in the street legally. The insurance company paid off my car but I was unable to get a comparable replacement. The drunk driver has been postponing court since August of 2016. The sheriff's department did not file the report on my car at the time of the accident I'm expected to drive three and a half hours away to go to court with no reimbursement from the county. Is there any way I can get help?

Sorry, but no. You accepted payment from his insurance carrier releasing all future claims.
