This past Friday, I was assaulted in the second degree at a nightclub. Now the person who attacked me, I know her and she has previously tried to assault me with a fork. Anyhow, we are both in the club and an hour into it, I am getting ready to leave. At the time I am holding my intoxicated friend, when I suddenly realize that I was being struck in the head with a bottle. Next thing I remember is being punched in my hands by the bouncers and being kicked out. As the bouncers are holding me in the inside of the club, I am automatically informing them, I was attacked by a bottle and I believe the head security personal, starts accusing me of starting the fight and that it was my fault for looking at the girl. Needless to say, I wipe my butt because I realize it was wet. I look at my hand and it’s full of blood. I inform the head security I'm bleeding and he is still telling me it’s my fault. He threw me out and my friend goes in to try to get napkins to cover my wound from bleeding anymore since my pants are ripped. They deny her access even after she told him that she needed napkins for the wound.
You would have to prove that they knew the accusation was false when they made it. If they can claim they had reason to think that it was true, they are off the hook.
