QUESTION

Can I sue due to deploying airbags?

Asked on Sep 12th, 2011 on Automobile Accidents - Virginia
More details to this question:
While my husband was driving to work today, his side airbags deployed (both of them). No impact to the side of the car was needed. There is no recall on the air bags. If the company does not take care of it, is there a need to get a lawyer? We bought the car right off the lot 2 months ago. Its a 2011 Nissan Titan. When we bought it, there were no miles on the car.

If your husband was not injured, and the only thing that happened was the deployment of the air bags, I would assume that the dealership/manufacturer will do the necessary repairs - particularly since it is such a new vehicle and presumably under warranty.  If you get an attorney involved, it is only likely to slow things down.  However, if there were personal injuries suffered as a result of the airbags, you may want to involve a personal injury attorney - if the injuries were significant.  If not, I would probably just consider myself lucky that the problem was detected in a a non-emergency and deal directly with the dealership.  Good luck going forward.
