Can I sue for an airbag that did not deploy?

More details to this question:
I was in a 1 car accident with only myself as the victim. I rolled over a hill and hit an tree head on. I had a head injury and my glasses were embedded into my face and therefore I have a nasty scar resulting from this. All of this talk on airbags not deploying, made me think back to my accident since I am permanently scarred from the accident. I have a call into the insurance company so they can tell if both front airbags deployed. If they did not, is this a case that I could file against the manufacturer for a defect of the brand new 2005 vehicle?

You may have a case but you should get a civil defective products attorney involved immediately. the only way you have a chance of recovery is by having the car towed and secured in a locked garage until it can be forensically examined by the manufacturers engineer and your expert. the experts will determine if it was the manufacturers fault, or the fault of a subsequent repair. In addition, a civil attorney can assess if its even worth filing. Obviously, the airbag didn't cause you to drive over a hill. He would have to determine if your percentage of fault would diminish the value of a law suit.
