I was sexually assaulted in my apartment, which he was since convicted. My apartment is a felony free community yet they ignored complaints about him because he was a guest of someone working for the apartments. Can I sue the apartment complex for the medical debt I now have?

If you can prove that the apartment management knew the guy's history, then you can sue.

You very well may have a claim for failure to protect under those circumstances. Consult a personal injury lawyer. Good luck.

You can try, but it is unlikely that you will prevail. How much control does the apartment complex have over its tenants. Even a person without a felony could have attacked you.

I think you can sue for more than that. I've never heard of a "felony free community", but if the apartment complex advertises itself as such, and residents complained about this individual, and yet they did not make him leave, I'd say that they are in violation of their own standard, which makes them liable not only for medical expenses, but physical pain and mental distress as well. You need an experienced personal injury lawyer in your area. Interview several and see who you are most comfortable with and confident in.

You can if you can prove a case, that is that the assault came about because of their failure to provide adequate security. Hard to prove. May cost some money to hire an expert on security etc but you could do it. I don't know anything about your facts so I cant say whether you have a good case or a bad one.

Yes you can sue for the assault. The fact that the apartment complex was warned about this individual and did nothing is the basis for your claim.

This is a case that I would be pleased to discuss with you in greater detail. There very well may be a case against the apartment complex based on negligence for allowing this person to be there despite warnings about his bad conduct. The fact that he was a guest of someone who worked for the complex helps in that regard. Much will depend on how he gained access to your apartment and the nature of this terrible assault. This is a case that is important to investigate further to seek justice for your injuries both physical and emotional and assure that this outrageous conduct never happens to anyone else at the apartments.

If management was aware of him and he had a record but they did nothing, you may have a case.

Yes. You may have a lawsuit against the apartment complex and the person who allowed him to reside in the community. Your claim may include damages for the medical bills, as well as other damages such as pain and suffering, emotional distress, and lost wages. You should consult with an attorney experienced in these areas who can fully evaluate your case.
