QUESTION

Can I sue for having me arrested?

Asked on May 07th, 2016 on Personal Injury - Michigan
More details to this question:
My wife called the police on me after we had an argument over some money. I saw her wallet in the diaper bag I went to pick up the bag she quickly tried grabbing It we began to pull the bag back and forth. I pulled it away( in fact I was the one who initially had the bag first, side question is this assault on her?) took the bag in the bedroom where I took the money out from her purse(police said this was not a crime since we are married) I grabbed some of my belongings and left. About 45 minutes later police show up to my mom's house they started questioning me on I told them my side they said she has a different story(of course) and that she was accusing me of assaulting her! I was arrested booked, finger printed, etc put in a cell for about 14 hours. A guard came to my cell and said I was being released. They processed me and said either the state see enough evidence or the witness is not cooperating (what's this mean) and that I should not return to the house. I was not arraigned, no hearing, not charged but released! I never assaulted her I never hit her only thing guilty of is yelling. Can I sue her for having me arrested? I almost lost my job cause I had know way to call in, it was embarrassing, degrading, humiliating. Also I believe she called CPS on me( I feel she was building a case against me for awhile in fact that day she went to an attorney and filed separation maintenance against me) they are also involved and say it's a category III case cause she was holding the baby as we were arguing and pulling the diaper bag. As of a few weeks ago she has admitted that I did not physically assault her but I did abuse her, ok what does that even mean? I'm also wondering can I sue CPS They are claiming it's a DV case when that didn't happen in fact I just heard on the radio a child was shot because his father left his gun out, CPS is involved and it's a category III case just like mine!

I think you need to see a counselor together so that this does not happen again. Lawsuits are not games to be played against each other. The Police had probable cause to arrest you based on a witness statement. The witness chose not to cooperate. This happens every day. You almost lost your job is not losing your job. You don't have any real damages.
