Can I sue for pain and suffering?

More details to this question:
I got hurt on my job by another employee. I was home for three months and when I went back to work they gave my position to someone else whom they hired only about eight months now and I have been on the job three years now. What action can I take at this time? They are also making the job harder for me since I am not even fully recovered from my injuries.

Your only remedy is/was worker's comp, for your medical bills and time out of work.

If your injury was caused on the job by another employee and no third party was involved then, as a general rule, Workers compensation is your only avenue with respect to "pain and suffering" . I suggest you contact a Workers Compensation attorney. Regarding your treatment upon your return you may have a claim against your employer under the American with Disabilities Act.
