QUESTION

Can I sue if a big machine fell on my back?

Asked on Jul 10th, 2016 on Personal Injury - California
More details to this question:
I work at a fast food chain and due to this paper, everyone who works there has to sign that we canโ€™t sue them. Two days ago, I was cleaning one of the big machine and it fell on me. It was so heavy, it took three people to take it off me.

Yes you may have a workers compensation claim as well as third party liability claim. The papers you signed will have to be reviewed to see if there is a preclusion for third party claim. But it cannot stop your workers compensation claim .

You should contact a worker's compensation lawyer in your area. The paper you signed is probably illegal and unenforceable to prevent you from pursuing a worker's compensation claim.

You have a potential workers comp claim, and possibly a third party claim as well. Please see a lawyer experienced in these cases.
