QUESTION

Can I sue my dentist for divinity crown placed incorrectly?

Asked on Jul 03rd, 2014 on Personal Injury - New York
More details to this question:
Roughly 7 years ago I had 4 crowns and a bridge on my front top teeth. After they were fitted, I noticed there was a large gap between the gum and one of the crowns. I returned to the dentist who said this was normal and filled the gap with filling. Over the past few years the filling has discolored and a black line has appeared across the crown. I went back to the dentist yesterday and she said the tooth underneath has started to decay but she will replace filling. I believe this is due to the crown being fitted incorrectly from day 1. What can I do?

First of all, you may have a statute of limitations problem: in NY, the limit is 30 months, but that can be extended if the same dentist is continuously treating you for the same condition. Secondly, you "believe this is due to the crown being fitted incorrectly". You may be correct, but to prove it, you need to hire an expert witness and we're talking 5G just to find out if there is anything to go on. Finally, even if there was malpractice, the likely range of recovery might be such that it would not be cost-effective to go forward regardless of the probability of success.
