Can I sue someone for hitting my car?

More details to this question:
This lady hit my car and is lying out of her teeth to her insurance company. Cops came to the scene but didn't write a ticket or file a police report. No injuries my insurance company will fix the damages but I have a 500 dollar deducible and no rental. So I would have to pay out of pocket.

Yes. Your insurance company will want to get their money back if you win. So, you'll need to sue for all the damages. Tell your insurance company what you are doing. However, your insurance company may sue her anyway and that may save you the time and effort. If they do, you can piggy back their case and join in to get all of your damages. Talk to your insurance company about what they plan to do. Good luck.

If your co. pays, they will do whatever is necessary to recover from the other ins. co., and will include the deductible in the claim.

You could sue her in small claims court for the damages you incurred.
