QUESTION

Can I sue the city?

Asked on Mar 02nd, 2024 on Personal Injury - Florida
More details to this question:
I am a small business owner, and just recently, news broke that our drinking water was found to be contaminated with fecal matter, and the water tested positive for E.coli. https://cbs12.com/news/local/riviera-beach-mayor-confirms-fecal-matter-did-in-fact-get-into-citys-drinking-water Once news broke, negative posts were disseminated on social media where people were vowing never to support restaurants in Riviera Beach. Since then, we have seen a decrease in traffic. This is coupled with the need for more support from city officials. They barely use local restaurants as a vendor for city-sponsored events. They utilize restaurants from neighboring towns or a national chain. Never the small business that needs the help.

Your complaint is more that the local government does not support your business. That is a political issue not a legal one. As to the water issue, thats generally covered by soveriegn immunity where you cannot sue the goverment for its discretionary or decision making conduct. Water contaminaiton is typically a short term issue solved by boiling the water or using bottled water temporarily.
