Can I sue the other driver for the cost of my down payment to get a new car after the other driver damaged my vehicle in a car accident? He had no insurance, but he had a job. I want to know if I can sue for the down payment that I had to pay out of pocket to get another car?

Sue who? They guy with no money and no insurance? To what end? It will cost you more in legal fees than you are likely to see from the effort.
