More details to this question:
The state recently spent millions of dollars (and plans to spend more) defending its ban on same-sex marriage even though a majority of the people support marriage equality.

Sure you can sue, but can you afford it? The average lawsuit are around $ 20,000 and the state has very deep pocket so they can out spend you?
