QUESTION

Can I sue them for harassment at work?

Asked on Feb 15th, 2013 on Personal Injury - Virginia
More details to this question:
Three men have been following me for about three months. I am in housekeeping. They are in maintenance. Two of them come in my area while I am cleaning. They come too close to my face, about 10 seconds and hit my cart with his penis. HR was involved. I got stress. I am at home. I have counselling treatment. I am so scared of them. Can I go to the court? What I need to do? I am scared to go back to work. HR says they will apologize to me but nothing. I am very traumatized. My doctor gave to me two weeks to stay at home. Please tell me what to do.

I have several cases just like yours. Your emotional injuries and stress are covered under worker's compensation laws and you are entitled to receive temporary disability benefits if you can't go back to work and also receive a settlement for your emotional distress and future psychiatric tratment. You also have a civil case against your employer for failure to investigate.

You have a claim for Indiana worker's comp benefits and may have a claim for sexual harassment under federal labor law. You should contact an attorney who handles Indiana worker's comp claims. The federal EEOC website covers issues of sexual harassment at http://www.eeoc.gov/laws/types/sexual_harassment.cfm

Contact an attorney about suing your employer for not providing a safe work environment for you. You can sue your employer for sexual harassment if your employer had knowledge of the incidents and did nothing to stop them from happening.

You have a comp claim against your employer. Talk to a lawyer familiar with Alabama comp law. You may also have a Civil Rights sexual discrimination claim against the employer. Call the EEOC (number in the blue pages) and talk with them. They will investigate and let you know if they think you have a case. They will also give you a "right to sue" letter when they are finished. You may want to you're your situation by a lawyer familiar with employment law before you talk with the EEOC, though. Finally, you may also have criminal charges for assault and/or harassment which you can bring against the offending co-employees. Talk with your District Attorney.

Go to the Idaho Human Rights Commission and file a sexual harassment claim. You need to do that before you can file a lawsuit. And you must do it within six months of the harassment.

Once you complain to the boss it is his job to stop the problem. If it continues after that you have a good claim for sexual harassment against the company. See if you find a lawyer listed in the yellow pages (on line or book) or if the bar has an office call the bar office and ask for any atty who handles sexual harassment cases.
