Can my friend still sue who ran him over?

My friend got ran over by a car on his motorcycle. They thought he was dead . He was in the ICU for 10 days, busted up pretty bad. Police report says weather conditions and speed were factors. No ticket was given. Insurance paid for the bike. He was knocked out for 2 hours. He was off work for at least 120 days. Is there a statute of limitations to file charges? Do they have the right to obtain his medical records without consent?

Your friend has 2 years from the date of the accident to sue for money damages in Alabama. Once suit is underway, the other side will be able to obtain his medical records with the judge's oversight.
