Can my husband avoid license suspension from sr22?

More details to this question:
My husband was involved in an accident where he was pulled over to the side of the road and was hit by a construction company truck who admitted fault to the CHP. The safety rep from the construction company came to the scene and admitted it was his guys fault. We had no idea until today that our coverage had expired about 3 weeks earlier. He drives for his job and we have 2 small children. He just got an amazing job and needs to drive. Can he still file a claim with the other insurance company?

If he was not operating his vehicle, no insurance would be required. If he is found to have been operating, he can only collect out-of-pocket expenses, not for pain and suffering.

You only need to be insured if you are claiming pain and suffering damages, but you are not barred as to out of pocket such as property damages, medical bills, wages, reasonable period of time to use a similiar rental car while your's is being repaired or for you to buy a replacement vehicle. ?If the other insurance company does not know you were not insured, don't tell them if the claim is only for out of pocket expenses. ?Get a copy of the report of damage form from DMV if it requires any information about your insurance and then decide if should put in N/A.

Yes, if in California. BUT, he will not be able to recover general damages for pain and suffering since he didn't have insurance when the accident happened. He will be able to recover for damages to his car, lost wages, and any medical expenses he incurs.
