More details to this question:
my son was in a car accident in Feb 2013. (he is on my insurance policy) claims adjuster deemed it total and unsafe to drive. He had no other means of transportation for school and work and was pulled over 2 times due to the damage to his back bumper. We just now receive a check for the car, however the claims dept put a "stop payment" on the check causing financial hardship. The insurance company keeps saying they didn't have all the forms but no one knows exactly what forms they are talking about.

You can file suit against a tortfeasor so long as you have never signed a Release or Settlement Agreement or in any manner released your claims as against a tortfeasor.  There are even exceptions to this rule.  You should talk with an attorney regarding having any and all documents reviewed so that you are aware of your rights.
