A week ago, I was at an event and bumped into a guy on accident he said some things I turned around and said something. He wanted to fight I did not and I tried to walk away and when I did he punched me the face and knocked me out. Well when he hit me he chipped one of my tooth's and when I fell to the ground I cracked another tooth. I went to the dentist and got them fixed and it ran $4800.00. My question is if I can sue him for the cost of getting my teeth fixed?
It depends on whether he was at fault and whether you contributed to your injuries by starting a fight. If you have brought criminal charges against him and he is found guilty, you can ask the prosecutor to get the judge to order restitution to take care of your medical bills as part of his sentence. Good luck.
Yes, you can sue him to recovery your dentist bill. You can also file assault 4, as a minimum, against him. Because of the amount of money involved, it may be assault 3.
Yes, he committed an assault and battery unjustified by anything you might have said. The problem becomes collecting anything from him as insurance does not cover intentional acts and many people are judgment proof.
Yes, you can sue for all your damages, including medical/dental expenses, the wages lost while you were receiving treatment, and pain and suffering. The main question is going to be whether you can prove your story in court.
Sure you can sue, and if it happened the way you describe you can probably win. But if the guy is out picking fights in public places it's probably a good guess that he doesn't have insurance to cover assault or net assets to collect a judgment from.
