Asked on Apr 09th, 2016 on Personal Injury - Ohio
More details to this question:
My husband pled not guilty to for a traffic citation that involved an accident. He went to trial, defended himself against the states attorney, and was found not guilty by the judge. We heard the other party say they had a personal injury lawyer and are planning to sue for medical bills and pain and suffering. The other driver was driving under suspension and had no insurance, but he was driving his pregnant girlfriend's vehicle that was insured.

Yes; Burden of proof in a civil case is preponderance of evidence, which is 51% he is at fault; Criminal case is beyond a reasonable doubt, which means any doubt of guilt, then your not guilty; Although being found not guilty in a criminal case helps, it doesn't mean you won't win a civil case; Ask O.J.
