Co worker ran over my causing injury. What should i do?

More details to this question:
I work at Home Depot and 2 co workers and i were heading out to lunch. I was about to get into the backseat of my co workers car while putting my right foot into the car my left foot was still on the ground. He thought I was in the car so he proceeded to move forward catching my left foot under his back left tire. My injuries are 3 broken toes and a fracture between my big toe and second toe. We were both clocked out for lunch so I doubt my job is gonna get involved so what should i do. Should I take legal action he says it was an accident but i doubt it
