QUESTION

Could I have a case of medical malpractice? How?

More details to this question:
Starting in April of last year my ob gyn did 2 ablations than proceeded to do a partial hysterectomy all within a 2 month period. After the hysterectomy I started having horrible unexplained pain. All my doc did was throw pain meds at me than sent me to a pain clinic. I eventually went to one of his partners and she asked me about adhesions (which I had never heard of at that point) my doc spoke with her and called me up very outraged. He informed me that he would schedule the laparoscopic surgery to check for adhesions but would not help with the pain management before or after surgery. Long story short I finally found a gynecologist specialist that could not believe the period all 3 procedures were done. I went through pt, more pain meds, neither calmed things down than by the grace of god I got a huge cyst on my left ovary. 2 days later, I had emergency surgery. They were going to go in laperscopically but when the doc made the incision, he found the adhesions were too thick to do it that way and had to open me up completely. That surgery was April 6, 2013 and guess what the adhesions are back but my surgeon does not want to help with the pain unless he finds a cyst or bowel obstruction. I am in so much pain and feel like I am starting all over again. Would I have a case with all this?

Who knows? Adhesion's are scar tissue and they are in abundance with every surgery especially in the area of the gut. The doctor does not cause them. nature does if you think you have malpractice you have to find doctor you trust who will review your entire medical file and tell you whether you got standard care or not. you probably did. No one guarantees the result of surgery. Some often there are bad results and pain that have nothing to do with malpractice.

Consult a medical malpractice lawyer. He or she will run your records by a medical expert for an opinion. Good luck.

Maybe, and only if it can be proven that the doctor breached the standard of care by having another doctor testify to that.

Adhesion can form just in the course of your life. Adhesion can form after surgery. Having adhesion is not, in and of itself, malpractice. As to the other stuff, you need to consult with a malpractice attorney.
