Could you please explain if this is pollution or an accident?

More details to this question:
I was having coffee outside of a coffee shop. There was an unlicensed and uninsured painter using aerosol paint for the shop owner. I was sprayed with that aerosol paint. I needed 911 assistance and was taken to the hospital with congestive heart failure, and admitted for a few days. The shop owners insurance says there is a pollution exclusion to the policy.

That's not "pollution".....they're full of you know what. Just go to a good personal injury lawyer, and when a lawsuit gets filed, it's amazing how that insurance company will come in and defend it. You ought to at least ask for the name of the company which was doing the spraying, as they might have insurance for this kind of thing, as well.
