QUESTION

Debt Collection after 6 years.

Asked on Jun 13th, 2013 on Automobile Accidents - Virginia
More details to this question:
Yesterday I received a bill from a rental car agency pertaining to an accident I had, my fault, six years ago. I was working at the time for an Non Profit Org. 501. I used their corporate card to rent said car in that it was for official business. The same day I had the accident I was told, by the President, of said group that "everything will be taken care towards the accident." At the same time, I waas covered by their insurance, medical, dental etc. I left this organization three months later for another overseas opportunity. Can I ask my current employer to cover this? in that they the president himself, no witnesses, told me they would take care of it, but obviously they didn't and that I have in my possesion the actual receipt for said rental car showing their corporate card as a means of payment. BTW I have also contacted this Organization's insurance company and they have no record, police or otherwise of a claiming being made. Thank you for your time.

Debt collection is not an area of the law that I practice but here are some suggestions.  Speak with an attorney that does debt collection to get some advice.  If you were on the job at the time of the accident, I believe that your employer and/or the liability insurance company for the employer, is primarily responsible for the damages.  In addition, check with the automobile insurance company that you had on the date of the accident (since your automobile insurance company would have secondary responsibility for the damages) to see whether it will pay for the damages.  Also, you can check with the credit card company to see if the card that you used to rent the vehicle, provided any type of insurance coverage that might cover the damages.  Good luck with this matter.
