More details to this question:
dad had dementia,am his daughter, but he never gave me his last name. he gave me power of attorney to care and pay his bills, he died from neglect and severe bed sores, i was suing the placed that cared for him. the attorney on the case send me to become his executor, he had no assets, property or money except what i saved to bury him with. do i need to be the executor to sue the home were they cared for him.he did not leave a will because he had no assets.

If your father died less than two years ago you may have an action for wrongful death, and if less than three years ago for pain and suffering. But the case cant be started before you or an appropriate person is appointed administrator of the estate.
