QUESTION

Did we settle for enough or just because our lawyer wanted to.

More details to this question:
2 summers ago my wife and I at house party. She leaned on 2nd deck rail in gave way she fell on her head 9ft below,grass walkway. gashed head and broke back in five places. Layed up for months, went back to work 5 months later. Just sat down with mediator, our lawyer, lawyer for ins. company, and lawyer for builder. With out telling us our lawyer had asked for 238k. We Settled for 170k. Everyone seemed happy but we think now with her continued physical discomfort probably always have and it seems now our lawyers push to settle and not go to court, we jumped at this too soon. Havn't signed anything yet, think maybe start price of 238k was way lower than what it should have been.

There are multiple parts of a successful claim for personal injury.  Certainly, the injuries you describe might justify a larger settlement.  However, there are other factors such as liability, which we don't know about.  It woulde be difficult to give a competent assessment based on the brief description you provided.
