Diminished Value Claim

More details to this question:
My husband was in an accident in which he received $1600 for diminished value. Upon looking at trading our car in the dealer was going to pay our car off. Unfortunately, we decided to wait on a new purchase. When we went back to make the purchase, we learned that the accident wasn't on the carfax report previously, and they know were offering 7k less than before. In reviewing the release of liability, it only had my husbands signature - and inadvertently did not include a witness or notary signature as requested. Do we have any options? Either with the insurance company from the person at fault that we worked with or can we make a claim with our own insurance?

If a release was already signed for the diminished value claim, it will be very difficult if not impossible to void the release/settlement.  The technicalities you mention probably to do not make the release/settlement voidable.  You could consult with a car accident lawyer in the area where you live to have that lawyer review the release but I doubt anything can be done.  Good luck with this matter.
