Do I get compensated after a car accident although I wasn't hurt?

More details to this question:
I was hit from behind in my Xterra by a taxi cab driver. After the insurance company examined my vehicle, I was sent a check for $26.12.

Insurance companies will sometimes offer you an amount for your inconvenience. They do this in order to get you to sign a release so that you can not come back to pursue them at a later date.

In Michigan, you would seek collision damages from your insurance company. You could seek up to $500 in collision damages from the owner of the taxi through the mini tort provisions of the no-fault law. As to personal injury damages, if you were not hurt there is no recovery.

This check was most likely for your property damage. You will not be compensated for personal injuries unless you can substantiate the same. You may also be compensated for an time lost from employment.

The short answer is, no. Unless you can prove you lost substantial work because of the accident or the value of your property damage was more than what you were paid. Also if someone related to you was in the car with you and they were very badly injured you could claim bystander emotional distress damages.

Under Michigan law, each party goes to their own insurance for the Property damage. You can sue the other driver for $500 or your deductible, which ever is less. You also go to your own insurance for unlimited medical expenses, and up to 3 years of lost wages, medical mileage, and household replacement services. You cannot collect for "pain and suffering" unless you have suffered a serious impairment of body function.

You can get compensated for your medical bills, future medical bills, pain and suffering, lost wages, mental anguish, and for any disfigurement. Since you did not have any of those types of damages for bodily injuries, the insurance company does not have to compensate you.

In Washington State, you are only compensated for the damages you actually suffer. Therefore, they owe you for any damage to your vehicle, including underlying damage that may be apparent once your car is taken apart to be repaired,any wage loss you may have suffered, etc. If you were not hurt, they do not owe you for any physical injuries.
